Nearly ten months later, the case is now at a crossroads. The preliminary hearing in the murder case of Tyler Robinson, accused of assassinating Kirk, began Monday in Provo, Utah. Robinson faces several counts, including aggravated murder, and the prosecution is seeking the death penalty.
For the five-day duration of the hearing, the Utah County Attorney's office is presenting its strongest evidence to prove to the judge that there is enough to establish probable cause that a crime was committed and that Robinson committed it. If that standard is met, the case moves forward to trial. Robinson has not entered a plea. As of Tuesday, July 7, the hearing is continuing into its second day.
Former UVU police officer Chris Bagley testified that he was working the event that day and was stationed on a rooftop walkway above the tent where Kirk was seated in the UVU courtyard. Kirk "was answering a question, a kid asked him a question. And then I heard a shot fired," Bagley testified, recalling that the time of the shooting was 12:23 p.m. local time. He testified that he saw Kirk fall to his left.
Prosecutors also presented testimony from Bagley in which he said he found a "sniper pad" on the roof of a nearby building. During cross-examination, the defense asked Bagley whether he could identify the person on the roof or what he was holding through the surveillance footage, and he said he could not. Prosecutors also attempted to introduce surveillance video compiled from Utah Valley University on the day of the shooting. An investigator said the video showed Robinson on campus both before and after the shooting, but because the video had been altered with markings and by zooming in, Judge Tony Graf sided with defense attorneys who said it should not be allowed. Prosecutors plan to reintroduce the footage on Tuesday after removing the alterations.
Prosecutors allege that Robinson sent a text message confession to his partner and left a note saying he had an opportunity to kill one of the nation's leading conservative voices, "and I'm going to take it." FBI Director Kash Patel also revealed that DNA on a towel wrapped around a rifle found near where Kirk was assassinated is a match to Robinson. Robinson is also charged with witness tampering because he allegedly told his partner to delete their text messages and to stay silent if questioned by police.
Members of Kirk's family, including his widow Erika Kirk, were present in the courtroom on Monday — the first time they had been in the same room as Robinson and members of his family. Kirk's parents and widow stood up and left the courtroom shortly after Bagley began testifying about the events leading up to and immediately after the gunshot. The Kirk family released a statement Monday morning, saying, "Charlie was a beloved husband, son, brother, friend, and father."
Robinson faces one count of aggravated murder, a first-degree felony, along with six additional charges. District Judge Tony Graf, who is presiding over the hearing, will weigh the evidence presented by prosecutors and decide if there is enough to hold Robinson over for trial and whether prosecutors can proceed in seeking the death penalty. The hearing is scheduled to run through Friday.
Because of Kirk's prominent public profile and closeness to the Trump administration, the case has attracted immense public attention. The proceedings each day are open to the public, but seating is extremely limited, and security at the Fourth District Courthouse in Provo has been very tight. If the judge finds probable cause at the end of this week, what follows will almost certainly become one of the most consequential criminal trials in recent American history — a case that sits at the intersection of political violence, free speech, and the justice system's capacity to deliver accountability.
