US Marshals arrested social media influencers Andrew and Tristan Tate in Miami on Saturday, July 19, on an extradition request from the United Kingdom following an investigation into sexual offenses reported by seven victims, according to the UK Crown Prosecution Service. The scene was jarring even by the standards of a case that has already spanned three countries and years of legal battles. Normally photographed in tailored suits and fitted shirts, the brothers wore tan jail uniforms and handcuffs during Monday's brief hearing. Neither said a word.

Andrew Tate, a self-proclaimed misogynist with billions of views online, faces 42 charges, including rape, human trafficking, indecent images of a child, and assault, according to the UK Crown Prosecution Service and Bedfordshire Police. Tristan Tate faces 17 charges, including sexual assault, rape, and trafficking. UK officials accused the brothers of abusing women in the East of England region, just north of London, between 2010 and 2017.

What the Court Documents Reveal

In court documents unsealed Monday, US prosecutors described allegations from the United Kingdom against the brothers involving three victims. One woman accused Tristan Tate of rape and assault during a long-term relationship with him beginning in 2012, including when she was unconscious, reporting him to UK authorities multiple times. Two other women — one who met Andrew Tate through a webcam business and another through a dating app — also accused him of rape and assault in 2014 and 2015.

The federal filings detail complaints made by women to British officials against both brothers about sexual and physical abuse, including claims the women were choked, sometimes to the point of passing out, and raped. The new charges were brought after Bedfordshire Police investigated reports made by four additional women. Beyond the UK case, in Romania the brothers face charges of human trafficking and forming an organized criminal group to sexually exploit women, and the state of Florida is also conducting an active criminal investigation into the brothers.

The Defense Strategy: Politics and Sovereignty

Their attorney, Joseph McBride, insisted the brothers are innocent and should remain in the US, adding that the attempt to have them extradited was politically motivated. Before the hearing, McBride referenced the Trump administration, specifically Secretary of State Marco Rubio — who has the final say on extradition requests — framing the case as a prosecution against free speech.

McBride also argued that "there is a long-standing agreement between the UK and Romanian governments that the UK would not seek extradition while the Romanian proceedings are pending," and noted that Romanian courts had ruled in 2024 that the brothers should be extradited to the UK only once their Romanian case concludes. However, any agreement or understanding between British and Romanian authorities would not legally bind the United States, which was not a party to it.

In the coming weeks, a US district judge will consider whether the brothers meet the conditions for extradition, with US Magistrate Lauren Louis setting another hearing for July 27. The US and the UK are part of an extradition treaty, and a strengthened version of that treaty took effect in 2007, with the State Department having since granted nearly every British extradition request. The extradition process requires a hearing before a US judge to determine whether the treaty's requirements are met, but the final decision rests with Secretary Rubio, who retains discretion to deny extradition.
